'Abu Ghraib & Guantanamo Bay: The Manipulation of the Law on Torture'

Mr Yogaratnam graduated from The University of Queensland in 2002 with a Master of Laws.

Mr Jeswynn Yogaratnam is a Human Rights law academic and principal law lecturer in Human Rights Law and Company Law at the Faculty of Law, Business and Arts, Charles Darwin University. He was recently named the 2009 winner of the Australasian Law Teachers Association’s (ALTA) Best Early Career Academic Conference Paper Award. The paper, entitled “Still see no evil, speak no evil of Guantanamo Bay and Abu Ghraib?”, was judged the outstanding entry and announced at the recent ALTA 2010 Conference.

Mr Yogaratnam will elaborate on his academic work and will critically examine the term ‘torture’ in the context of international law and domestic law in the United States. He will make specific reference to the coercive interrogation techniques applied in Abu Ghraib and other detention centres in Iraq, as part of the United States’ battle to combat terrorism post 9/11.

This lecture will also focus on striking the balance with lawful interrogation techniques and will serve to remind people that the manipulation of law could occur in any modern democratic nation.

Jeswynn Yogaratnam’s main areas of interests are anti-terrorism laws and rights of detainees; indigenous land rights in Malaysia and Australia; capacity building (civil, political, social, economic and cultural rights) in Timor Leste; and fiscal policies on climate change in altering industry behaviour.
